Why would you serve a legal notice on someone who is non compos mentis?

In what can only be described as an unnecessary way of adding insult to injury, police in Las Vegas, ticketed a comatose13-year-old Las Vegas girl for jaywalking as she fights for her life after being nailed by a car on her way home from school.

According to witnesses, 13-year old Takara Davis, an 8^th grader at Lawrence Junior High School, was trying to catch up with friends when she was struck by a driver, who was presumed to be texting , which put her  into a medically induced coma and wired to life support.

Instead of police going to the hospital to give her mother, Kellie Obong, their condolences, they instead handed her a ticket for jaywalking.

“He said, ‘Takara was jaywalking. She has got to go to court on March 6th,’” Obong said. “If she was jaywalking, then she was jaywalking. But maybe you give it to me at a later time. Don’t give it to me when they are rushing her into the operating room.”

A spokesperson for the Metropolitan Police Department issued a statement about how the citation was issued, saying, “Our officers conduct themselves in a professional and compassionate way. We wouldn’t do anything deliberately insensitive.”

The ticket did not have to be issued. It would be inadmissible at trial anyway. If she was jaywalking, it would be in the police report and the insurance company could use it to determine fault.
